Foreclosure Update – November

Preforeclosure inventories dropped 11.8 percent in October from the prior month, largely thanks to a 16.8 percent drop in Notice of Default filings. Foreclosure suspensions led to a 29.9 percent decline in foreclosure sales that went Back to Bank (REO), and a 26.4 percent decline in those Sold to 3rd Parties. Despite the significant decline in new Bank Owned (REO) properties, Bank Owned (REO) inventories actually rose, as REO resales continued to slow.

Grace Borzini of Oak Shores Realty in San Luis Obispo County has earned the prestigious Certified Distressed Property Expert (CDPE) designation, having completed extensive training in foreclosure avoidance and short sales. This is invaluable expertise to offer at a time when the area is ravaged by “distressed” homes in the foreclosure process.

Short sales allow the cash-strapped seller to repay the mortgage at the price that the home sells for, even though it is lower than what is owed on the property. With plummeting property values, this can save many people from foreclosure and even bankruptcy. More and more lenders are willing to consider short sales because they are much less costly than foreclosures.

In the San Luis Obsipo County area, 9% more homes than last year are in danger of foreclosing. It is happening in all price ranges. Local experts say that even high-priced homes are not immune.

“This CDPE designation has been invaluable as I work with sellers and lenders on complicated short sales,” said Borzini. “It is so rewarding to be able to help sellers save their homes from foreclosure.”

Alex Charfen, founder of the Distressed Property Institute in Boca Raton, Fla., said that Realtors® such as Borzini with the CDPE designation have valuable training in short sales that can offer the homeowner much better alternatives to foreclosure, which virtually destroys the credit rating. These experts also may better understand market conditions and can help sellers through the emotional experience, he said.

The Distressed Property Institute opened in January 2008 and provides training on-site and online. The CDPE is the premier designation for Realtors helping homeowners in distress and handling short sales.

Since Oak Shores Realty has diversified these past three years into Foreclosures and Short Sales in addition to specializing in Oak Shores I thought I would answer some common questions I receive from clients to help you better understand the current state of the Real Estate Market.

Q- What is a short sale?
A- A short sale occurs when a owner of a property owes more than the property is worth but does not want to let property go to foreclosure. We help owner determine if they are a candidate for a short sale. We list property at current market value. We get an offer and we negotiate with the lender and we get lender to agree to accept less than is owed to that lender at the time of the sale of the property. I was told by one title company county manager not long ago that roughly 20% percent of all short sale escrows actually close in San Luis Obispo County. This is because most mortgage lenders ultimately don’t agree to sellers’ requests to take less than what is owed. It also is due to many agents’ inexperience in dealing with a short sale. We have used a short sale expert for the last three years and currently have sold several short sales in Oak Shores. www.IwantaShortSale.com for further information!

Q- What happens if a lender doesn’t agree to a short sale?

A- Usually, the lender forecloses and, unless someone successfully bids at the foreclosure auction, the lender takes the property. The property then is an REO, or as the asset appears on the bank’s balance sheet, “Real Estate Owned.” www.IwantaShortSale.com

Q- An offer was prepared for us months ago on a property whose sellers were trying to accomplish a short sale. We haven’t heard if or when our offer will ever be approved by the seller’s lender. Why can’t we at least get the courtesy of an answer?
A- There are several reasons for this frustrating process. The banks are overwhelmed by the tidal wave of foreclosed properties, sellers requesting loan modifications, requests for banks to accept deeds in lieu of foreclosure and short sale requests. They weren’t, and still aren’t, staffed to deal with it all. There are other reasons but, generally, this is a very inefficient, imperfect process with often predictably unacceptable results. www.IwantaShortSale.com

Q- Can we offer less than asking price on a distressed property?
A- It depends. If similar properties are engendering multiple offers and bidding wars, the answer is clearly another question, “Why would you?” On the other hand, if the property is very unusual, such that there is no competition for it, then it certainly doesn’t hurt to seek a discounted price and/or other concessions.

Q- We recently had an offer accepted by an asset manager who works for a bank that acquired the property from foreclosure. Then you presented us with a 12 page addendum from the bank that effectively changed and deleted a number of provisions in our offer. You said that if we wanted to purchase this property we would have no choice but to sign the “addendum.” Why?
A- When you purchase a bank-owned property, this is essentially the process: I submit your offer to the seller’s agent who enters a few key details about your offer onto the bank’s asset manager’s website’s submission page. If your offer is acceptable to the asset manager, the listing agent receives an addendum from the asset manager that is essentially a new contract. The reason for the addendum is that banks’ attorneys do not agree with some provisions contained in the winforms State of California Real Estate Purchase contracts.

Q- So what sells homes these days?

A- Without question, proper pricing, proper preparation and presentation of the property and exposure through the Multiple Listing Service coupled with emerging Internet technologies. Meanwhile, the popularity of printed media has declined dramatically as a place to go to for information about homes and real estate in general. Internet is the dominant force.

It’s hard to believe that the holidays are right around the corner with Thanksgiving a little over two weeks away!  Living on Lake Nacimiento means being able to fully enjoy the sights, aromas and tastes that the holidays bring!  If you currently live in the gated Oak Shores or Heritage Ranch communities on Lake Nacimiento, you’re already well aware of how beautiful and fun-filled this season can be!

To kick off this great season, the nearby town of Paso Robles is hosting an event this Saturday, November 13 from 5-8pm in its charming downtown.  The 2010 Evening of Elegance in Paso Robles will feature holiday refreshments and entertainment and is free and open to everyone! You’ll enjoy “live mannequins” performed by the Class Act Dance Studio, as well as trolley rides, singers and musicians and much more!  At 8pm, the Gala Paderewski Festival Concert will take place at the Paso Robles Inn.  You can view more information about the event at the Paso Robles Downtown website.  Don’t miss out on this fun opportunity to kick off the holiday season!

There are other ways to get ready for the colder winter season and making sure your Lake Nacimiento home is prepared is very important!  Although living in Central California doesn’t produce harsh winters, it’s still vital to winterize your home to keep it in excellent condition.  Below are a few things you can do now to get ready for cooler weather.

1. Check for Leaks
– Weatherstripping and caulking is probably the least expensive, simplest, most effective way to cut down on energy waste in the winter. Improperly sealed homes can waste 10 to 15 percent of the Lake Nacimiento homeowner’s heating dollars. You’ll want to check around doors for leaks and drafts.  Consider replacing old windows for newer, more efficient ones. Also, don’t forget to shut the fireplace damper if you’re not using your fireplace.  This can easily allow cold air in and heat out!

2. Check Your Insulation- This is key to saving on your energy bill this winter!  Be sure to check your attic for insulation as older homes in Lake Nacimiento have little to no insulation since they were built prior to the push for energy efficiency.  Weather-strip and insulate your attic hatch or door to prevent warm air from escaping from the top of your house. You’ll also want to seal any holes in your attic or basement.

3. Check Your Heating System- It’s important to get routine maintenance and inspection on your heating system each fall to ensure it’s working correctly. To make your heating system work more efficiently, replace your heater’s air filter each month.  Cleaning and removing dust from along baseboard heaters and vent will help use less energy.  Reversing the switch on your ceiling fan will help blow hot air from the ceiling down, instead of circulating cold air into your home.

You’ve heard the reports of the current Lake Nacimiento Real Estate market being ideal for home buyers.  If you’re hoping to buy a home soon on Lake Nacimiento to get in on the low mortgage and interest rates, as well as record low prices; there are a few things you’ll want to keep in mind before starting!  Jumping into the current real estate market can feel like a whirlwind if you’re not aware of what to expect, and there are some mistakes that can easily be avoided.

1. Not getting pre-approved before house hunting- Before you start house hunting, narrow down your price range by getting pre-approved. Shop for a Lake Nacimiento lender or mortgage broker you can trust. The mortgage pro will review your credit, income, assets and debts, and recommend a mortgage with monthly payments that fit your budget. Not only does this let you know how much house you can afford, it also lets sellers know that you’re serious about buying.

2. Buying a house you can’t afford- It seems that our nation is learning its lesson in spending more than you can afford, and it’s no different in your Oak Shores or Heritage Ranch purchase. Just because you get approved for a larger loan than expected; doesn’t mean you should buy a home at that price. Be wise in thinking through what you can actually afford and factor in any repairs or updates you plan on making in the Lake Nacimiento home.

3.  Not reading the fine print- It’s smart to have your Lake Nacimiento Real Estate review all your paperwork and discuss it with you so you don’t get caught off guard at closing. There are a few documents and items that are truly critical, and you can request a copy of these in advance. This gives you time to review them and ask questions before closing.

4. Waiting for the market to improve or not buying at all- No one can predict precisely where the market is going, so trying to time your Oak Shores or Heritage Ranch purchase with the bottom of the market is risky. All the time you spend procrastinating on purchasing a Lake Nacimiento home, you could be building equity, getting tax deductions and enjoying the many other benefits of homeownership!

5. Forgoing a home inspection- Even if a home appears to be in perfect condition, it’s a mistake to assume that it’s actually problem-free. Even brand new homes can have defects, so getting a professional inspection before making the commitment to buy is crucial. Be sure to attend the inspection so the inspector can explain any issues.

6. Falling for love at first sight- There are many beautiful homes in Oak Shores or Heritage Ranch from which to choose.  However, if you don’t shop around the Lake Nacimiento Real Estate Market and see what else is out there, you could miss out on a good deal or potentially regret your purchase. While you don’t need to visit every home on Lake Nacimiento, you should compare at least three homes before you make a decision to ensure that you’re getting the right house at the right price.

7. Thinking short-term- The Lake Nacimiento home you purchase should be a place that feels like home to you and your family, but it’s important to remember that it’s also a huge investment. When shopping for a home, it pays to think about resale down the road. Search for homes in sought-after neighborhoods like Oak Shores or Heritage Ranch, and look for features that future buyers will want, such as a great kitchen and lots of storage space.

8. Making an offer without contingencies- Having a back-out plan is a must for smart home buying. If the home has an irresolvable flaw, it doesn’t appraise for the purchase price, or your lender refuses to fund your loan, having contingencies on your contract gives you the right to cancel the transaction.

November 2010 Market Watch for Monterey County and North San Luis Obispo County

North San Luis Obispo County Active Listings: There are a total of 2,128 properties actively on the market with an average list price of $666,617.


North San Luis Obispo County Sale Pending/Sold: There are currently 223 properties with sales pending and 1,113 properties that closed in the past 6 months.  The average sold price is $411,907 and the average time on market is 106 days.

North San Luis Obispo County Absorption Rate/Supply: The current month supply of homes on the market is defined as the ratio of the current inventory of active listings compared to sales.  In other words, given recent sales activity, one can estimate how long it would take for the entire inventory of active listings to sell, assuming no new listings were to appear on the market.  At the present time it will take almost 10 months to sell all of the current active listings, without adding any new homes for sale.

Monterey County Active Listings: There are a total of 1,738 properties actively on the market with an average list price of $1,230,116.
